Neural Booty - DMCA Takedown Policy

Neural Booty ("we," "our," or "us") respects the intellectual property rights of creators and complies fully with the Digital Millennium Copyright Act (DMCA) and all applicable copyright laws. It is our policy to respond to valid copyright infringement notices and take appropriate action, which may include removal of material or disabling access to content processed through our Service.

If you believe that your copyrighted work has been infringed by a user of Neural Booty or by content accessed through our Service, please follow the instructions below to submit a formal DMCA Takedown Notice.

1. Filing a DMCA Takedown Notice

To submit a valid DMCA Notice, you must provide a written or electronic communication that includes all of the following information (per 17 U.S.C. § 512(c)(3)):

• A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
• Identification of the copyrighted work claimed to have been infringed.
• Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material.
• Your contact information, including full legal name, email address, physical address, and telephone number.
• A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
• A statement that the information in the notification is accurate, and under penalty of perjury, that you the copyright owner or are authorized to act on behalf of the owner.

2. How to Submit a DMCA Notice

Please ensure that your notice includes all required information as outlined above to facilitate prompt processing.

3. What Happens After You Submit a Notice

Once we receive a valid DMCA Notice:

• We will review the request.
• If the notice is complete and legally valid, we will remove or disable access to the content identified.
• We may notify the user who posted or accessed the material.
• We may provide that user with a copy of your notice.
• The user may submit a counter-notice if they believe the content was removed in error.

We reserve the right to refuse DMCA notices that are incomplete, fraudulent, or abusive.

4. Filing a Counter-Notification (If Your Content Was Removed)

If your content was removed due to a DMCA Notice and you believe this was in error or that you are legally authorized to use the material, you may file a Counter-Notification under 17 U.S.C. § 512(g).

Your Counter-Notification must include:

• Identification of the material that was removed or disabled.
• A statement under penalty of perjury that you believe the removal was a mistake or misidentification.
• Your name, address, telephone number, and email.
• A statement consenting to the jurisdiction of the Federal District Court for your address (or for Neural Booty's jurisdiction if you are outside the U.S.).
• A statement that you will accept service of legal process from the original complaining party.
• Your physical or electronic signature.

Send your Counter-Notification to the same DMCA Agent listed above.

Once received, we may restore the material unless the original complainant files a legal action seeking a court order within 10-14 business days.

5. Repeat Infringer Policy

Neural Booty may suspend or terminate accounts belonging to users who are found to repeatedly violate copyright laws or submit fraudulent claims.

We reserve the right to determine what constitutes a repeat infringement pattern.

6. Misuse of the DMCA

Submitting false claims, fraudulent takedown notices, or knowingly misrepresenting infringement may result in legal liability, including damages, attorney's fees, and penalties under 17 U.S.C. § 512(f).
